You have some sort of other problem
I currently own all 3 generations of the 4k Apple TV, an Nvidia Shield and a custom HTPC. The 2nd and 3rd gen 4k Apple TVs are my default for day to day use.
While I prefer the design of the updated Apple remote, I do have connectivity issues with it. I also have a reoccurring issue where the right navigation button registers double presses at times.
With the new models expected this year, I would wait unless you absolutely need one now.

Some streaming apps linked to our cable provider need to be occasionally force-restarted in order to view anything.
To force-restart apps I need the ATV remote and oftentimes I'll accidentally hit the microphone button on the side which is a little too easy to press IMO.
Those aside the ATV has been great for me. Fast and fluid. Never buying another Amazon stick for our living room.
The remote isn't IR, line of sight is irrelevant

He said he's using a TV IR remote + HDMI CEC to work around the (bluetooth) connectivity issues with the Apple TV remote.
I have similar connectivity issues, particularly when I rest the Apple remote on my body. Moving the Apple TV from behind my TV has helped but has not eliminated the problem.
I haven't seen this issue with prior generation Apple TVs or the old remote. There is something about the 3rd gen 4k Apple TV and/or the remote where the RF connection is not at solid as the prior implementations.

Agreed. Un-pair and then re-pair the remote. Had that occasionally happen on an older AppleTV model.
Exactly. $99 or bust
The Apple TV for whatever reason will not turn the TV on via CEC. I threw the Roku on the same input, and everything turned on correctly again.
I think there are some CEC handshake issues with the Apple TV and the Samsung S95D for what we reason, but it's essentially unusable for me at the moment
